Yesterday I had to sit in Federal court, to learn that the Feds want to go forward on the Barry Bonds case, even though the 9th Circuit Court of Appeals held up Judge Illston's ruling, so now they will have to scramble to come up with a viable case. It's been my considered opinion since the very beginning that there never was much of a case; if this were poker, they wouldn't have a pair of deuces. I sat in the courtroom for about an hour, to hear the lawyers and judge decide when they could all get together, and it looks like it won't be until March of 2011.
Cui Bono? Who benefits from this display of forensic pathology, other than the lawyers? They get paid to drag out procedures as long as they wish, which is punishment itself. What makes this display of prosecutorial bullying most egregious is that at a time when our nation is under siege from economic collapse, this is costing the taxpayers even more than it's costing Barry Bonds. Over the years, I've attended all the hearings. Being on trial is an ordeal, and it helps if you have people who've got your back sitting behind you. The court personnel, lawyers, and media people all recognize me. It's easy to talk to most of the reporters, and one whose judgment I trust said that it's more about Rusionello's rapacious ego than any attempt at achieving justice.
So where's the justice here? I've got quite a bit to say on the matter, I've had a lot of time to think about this and know the issues. If anyone reading this objects to my considered opinions and the conclusions I come to, either point out the flaws in my reasoning or direct me to evidence I have not considered. Since Barry is accused of perjury during grand jury testimony, it's important that those who would judge him read the actual testimony, and then decide for themselves. Lawyers often try to "trip up" witnesses, abuse them and use various methods to confuse a hostile witness, in hopes of impeaching the witness. It's important to define the terms carefully. Perjury means deliberately lying in court. The prosecutor must prove that the accused intended to lie, and it's never been a very easy thing to do, prove what another person was thinking. Those who insist that Barry must be tried "because he lied in court" don't seem to understand that a prosecutor doesn't have to bring charges even if a crime has been committed. I
